The biggest most powerful out-of-control government bureaucracy you've never heard of
Ilya Shapiro, Constitutional scholar at the Cato Institute, spoke to the Phoenix Federalist Society Thursday evening about the atrocious government agency known as the Public Company Accounting Oversight Board (PCAOB), which Shapiro calls "Peek-a-boo." Created in 2002 by the Sarbanes-Oxley Act of 2002 to act as a watchdog over business, it was approved 99-0 in the Senate and 423-3 in the House. It has turned into an unaccountable bureaucracy, virtually its own tiny microcosm of government with the board yielding all powers traditionally divided among three branches of government - it creates and enforces laws, prosecutes, enforces penalties, and levies taxes, all independent of any real oversight.
It has proven quite costly, costing the economy $1.5 trillion net (and that's after any benefits are taken into account). The SEC is supposed to oversee it, but members can only be removed "for cause" which means only if they are found guilty of willful misconduct. Board members make astronomical salaries, $550,000/yr and $650,000/yr for the chairman. Shapiro joked that due to all the business Peek-a-boo has brought the London Stock Exchange as it fled the U.S., London should erect golden statutes to Congressmen Sarbanes and Oxley.
Fortunately, the Competitive Enterprise Institute has filed a lawsuit challenging its constitutionality. This is proving to be the most important separation of powers case in 20 years. Justice Kennedy is expected to be the swing vote. Due to the current anti-big government spending mood across the country, Peek-a-boo's days may be numbered.

Tax Day Tea Party Endorses JD Hayworth
Fellow Patriots,
Last week we posted a poll for our readers that asked a simple question.
Would you support J.D. Hayworth in his run against John McCain in 2010?
The results? Out of about 3,500 votes, 79% of you said you would indeed support Hayworth in his challenge to John McCain for the Arizona Senate Seat.
As I told our committee on our conference call with J.D. Hayworth this week, the overwhelming amount of emails coming in support of J.D. Hayworth makes this feel like the special election in MA for Scott Brown that took place earlier this year.
In that particular scenario, Scott Brown was the underdog just six weeks before the election. In fact, at the time, he trailed by 30 points! But once the movement unified and rallied behind him, he was able to overcome the special interest and big money behind progressive candidate Martha Coakley.
It is the opinion of our committee that John McCain has become a problem for our movement. His progressive positions in the Senate have been damaging to our efforts, and in many cases he appears to position himself against what we as a movement stand for.

Experts agree the flow of new illegal immigrants entering the United States is decreasing, but they don't agree on whether the number of immigrants leaving has risen.
According to newly released estimates from the Department of Homeland Security, Arizona's illegal immigrant population fell from 560,000 in January 2008 to 460,000 in January 2009 — a drop of 18 percent.

Nationally, the illegal immigrant population dropped 7 percent over the year, from 11.6 million to 10.8 million.
The decrease followed a surge that saw Arizona's illegal immigrant population grow by 70 percent and the national illegal immigrant population grow by 37 percent between January 2000 and January 2008.

PHOENIX, ARIZONA. FEBRUARY 24, 2010. Yesterday, the McCain campaign issued a sophomoric press release attempting to discredit conservative challenger J.D. Hayworth’s endorsement from the Americans for Legal Immigration, anational leader in the fight against illegal immigration. The McCain campaign used sloppy research to suggest this group and anyone that disagrees with McCain or his amnesty plans is a hate monger. It was offensive not only to the Hayworth family but also should be to any American.
To borrow a phrase from the McCain family, “NOH8”. Furthermore, neither Arizona nor the country needs a lecture from John McCain on race relations, someone who once defended Gov. Evan Mecham’s roll back of Arizona’s Martin Luther King Day.
“John and I have profound differences in this Republican primary. He’s a moderate and I’m a conservative. But let’s not allow the campaign to degenerate to this level. People who oppose him and his open borders policies are great Americans, just like John is,” Hayworth said.
For example, below are four examples of Ku Klux Klan and other extreme supporters of McCain. The Hayworth campaign does not believe they make McCain a hate monger. In fact, the Hayworth campaign has gone out of its way to commend McCain’s service to the country.

“The disappointment we’re going to suffer from [Obama] is going to set us back another fifty years.
McCain is definitely the better shot for black people,” said Yahanna, a General from the Israelite School of

women, American culture, Muslims, Christians, Martin Luther King Jr.”.
“As far as Obama/McCain I couldn’t even make up my mind until McCain picked Palin and now I will

McCain is vulnerable to the more conservative Hayworth on pro-life and pro-family issues as well as illegal immigration. McCain opposed the Bush Tax Cuts in 2001 and 2003. Hayworth also has a better lifetime rating from Citizens Against Government Waste and the American Conservative Union than the 28-year member of Congress.
McCain voted for the $850 billion bailout of the big banks which included $150 billion in pork, proposed a $300 billion bailout for mortgage lenders and, according to the Heritage Foundation, sponsored an amnesty bill that would have cost taxpayers $2.6 trillion over the long-term. Just this past week McCain has been ridiculed across the country for claims that he was “misled” into voting for the bank bailout, despite his failure to voice any concerns that are now being expressed by him.

Tribute to Tom Stewart, a friend to the conservative community

Tom Stewart, the founder of Services Group of America, died, along with his wife, Madena, his five year old daughter Sydney, and two others, in a helicopter crash north of Phoenix, Arizona, a week ago Sunday.
It was a privilege to have known him, even slightly. He was a very private man and, in his very private way, a national treasure. Although prominently noted in Arizona and Washington State, where he built his business, his passing deserves national notice.
As his corporate biography states, Tom “was a long-time philanthropist who supported education and the arts; a community activist championing free enterprise over government intervention; and an adventurer visiting the far reaches of the globe.
“His 40-year career was remarkable for its continual theme of building successful companies along a road that took him from the rough docksides of Seattle to the careful development of one of the fastest growing and most successful privately-held corporations in America. “
“Growing up in Seattle, especially on the waterfront, was no gilded existence. The weather can often be bleak and the work hard. In lieu of allowance, his father always had work for him to do every school break and summer vacation. As he grew older, his resolve to follow his own path grew stronger.
“Tom Stewart sat atop a multi-billion dollar enterprise that employs thousands of hard working Americans as its sole owner and chairman. Services Group of America's very existence is living testimony to his skill as an opportunistic visionary, a deft financier and a calculating risk taker.
“A consummate world traveler, visiting 128 countries, Tom Stewart was an avid golfer, horseman, rancher, fisherman, skier, pilot, scuba diver and team roper. He appeared in rodeos across the country. He also enjoyed the beauty of gardening and hit the road regularly on one of his seven Harley Davidsons - on which he has ridden from Miami to Seattle, from Mexico to Canada and all over Europe.”
Rachel Alexander, a Phoenix resident who was named 2009 Activist of the Year by Right Online, had this observation: "Tom Stewart was a true Renaissance man. This is a great loss for America. Tom had a strong commitment to free market principles. He followed through with support for principled conservative candidates. With Hayworth, has McCain met his Waterloo?
Arizona Sen. John McCain has raised the ire of conservatives over and over and over again. He wore the label of "maverick" as a badge of honor, but rather than use it as a moniker for standing up for conservative values against the party, he used it to support the party over conservative values. Now, rather than an easy primary, McCain faces former six-term congressman and conservative talkshow host J.D. Hayworth.
For me, McCain is summed up by the following:
While understandable that Palin would support the man who put her on the national stage, other candidates who vouch for McCain's "conservative" credentials are doing a disservice to the movement. And it doesn't look like it's going to fly this time around. The groundswell of grassroots attitudes are emodied in the Tea Party movement, and McCain represents everything they are against. We need smaller government, citizen legislators, and a respect for the Constitution. Hayworth has been there... then been back in the private sector, working to promote conservative principles. Now, he's looking to go back to replace a man who is an icon for establishment Washington.
He voiced opposition to President Bush's tax cuts and said he favored "targeted" tax cuts. The word "targeted" is code for social engineering and not based on conservative principles that the money does NOT belong to Washington.
He repeatedly supported attempts to push amnesty for illegal aliens unto the American people. Americans spoke out, and neither effort such as the McCain-Kennedy bill went anywhere, but McCain continued to push.
He supported the McCain-Feingold campaign finance bill which has been ruled UNCONSTITUTIONAL.
He joined the "Gang of 14" which allowed quality, conservative judicial nominees to fall by the wayside.

Goldwater Institute: AEA president has facts wrong about Florida education reforms
Last week, I had the opportunity to discuss Florida's education reforms on KAET-TV's "Horizon" with Arizona Education Association President John Wright. We were discussing the Nation's Report Card scores for Florida and I was surprised to hear Mr. Wright make the following claim: "The steepest increases that Florida saw in both reading and math scores were between 1994 and 2002--before most of these reforms took place."

John McCain's TARP claim 'cowardly'
Rep. Barney Frank on Monday night called Sen. John McCain (R-Ariz.) “cowardly” for suggesting that he was misled by then-Treasury Secretary Henry Paulson and Federal Reserve Chairman Ben Bernanke in order to get his support for the $700 billion Troubled Asset Relief Program.
Asked about McCain’s claim by MSNBC’s Rachel Maddow, Frank said it was a “pathetically, obviously untrue statement .” “It’s an invention,” the chairman of the House Financial Services Committee said of McCain’s claim. “Look, he’s got a very conservative primary opponent. He voted for the TARP money. He clearly supported it. And he’s now just trying to reinvent history, but it’s unseemly for a man like that to blame other people, because he changed his mind for political reasons.”
“Those of us who were there know it,” the Massachusetts Democrat said of the meeting Paulson and Bernanke had with lawmakers to request the funds. “I`ve gone beyond being disappointed for John McCain to feeling sorry for him.”
“For him to blame Paulson or Bernanke is cowardly,” Frank continued. “This was Bush. Paulson and Bernanke were acting for [former President] George [W.] Bush.”

John McCain refused to listen to over 80% of his constituents and the American public by Co-Sponsoring Amnesty legislation with Senator Kennedy in 2007 that would have turned millions of illegal aliens into US voters. McCain's Amnesty legislation failed after the Capital phone system collapsed under the pressure of angry calls ranging 50-100 to 1 against his bill.
McCain apologized to and misled Republican voters in the 2008 GOP Primary for President by claiming he had changed his position on Amnesty and after winning the primary, he flip flopped and returned to his prior pro-Amnesty positions, which left many voters feeling they could not trust John McCain.
JD Hayworth supports immigration enforcement and border security measures, instead of McCain's amnesty legislation that would politically destroy America's ability to enforce immigration laws in the future. Hayworth's prior voting records in Congress, position statements as a talk radio show host, and his campaign stances are aligned with ALIPAC's platform and the super majority of American voters who support more immigration enforcement.
