County Attorney Andrew Thomas Wins Debate on Horizon; Nelson Fumbles Challenge to Answer Which Current Death Penalty Prosecutions He Would Not Pursue

Nelson Has Pledged to Reduce Death Penalty Efforts; Once Tried to Stop Capital Punishment for Convicted Double Murderer


PHOENIX, AZ - OCTOBER 21, 2008. Throughout his campaign ACLU lawyer Tim Nelson has said Andrew Thomas seeks the death penalty too often and that he would not seek it as much (politickeraz.com, East Valley Tribune).

So, at a Tuesday night Horizon television debate, Thomas posed a simple challenge to Nelson: Which of the current death penalty cases Thomas’ office has successfully prosecuted, as well as the ones it is pursuing the death penalty for would Nelson decline to pursue?

Nelson looked dumbfounded, confused and was ultimately unable to answer the question when Thomas presented him with the current list of cases. In fact, Nelson failed to answer the question the three different times Thomas asked him during their joint appearance on Horizon.

The lists presented to Nelson Tuesday night are below.

Nelson previously came under fire from Thomas for failing to disclose his efforts to stop the death penalty for convicted double murderer Jose Ceja. Ceja brutally killed a Phoenix couple.

“I believe the death penalty is a specific and general deterrent. My opponent does not. There are public safety consequences to him not as aggressively pursuing death penalty convictions. Of the current cases, the public has a right to know which ones he would not pursue,” Thomas said.

These people have committed crimes that are difficult for me to comprehend. I sometimes try to think what it must feel like to be capable of doing such cruel and sadistic things. But I can't even get to a place where I feel that I would WANT to hurt someone else, much less go through with it.

I suppose I am a somewhat odd case, because I believe in the Death Penalty, but I think it must be applied far less often. No REASONABLE person believes that the capital punishment system is as perfect as it can, and should, be.

And I'm not even saying we should suspend the Death Penalty until we fix everything. What I AM saying is that human life is worth something in Arizona, and we must take every possible step to preserve it. The Death Penalty is meant for the MOST heinous and cruel behavior. Any pre-meditated murder is morally repugnant, obviously. It would be difficult to argue, however, that a prolonged torture/rape killing of a child, for example, is equivalent to a fatal gas station shooting in terms of cruelty.

Most of the time when I state my belief in applying the Death Penalty less often, pro-DP believers allege that I value to killer's lives more than the victim's. I believe that is irrelevant, as the victims are dead. Surely, if I were able to intervene during the commission of a capital crime by ending the life of the offender, I would do so to save the life of the innocent.

I would like to hear a legitimate argument AGAINST applying the Death Penalty less frequently.
