Goldwater Institute: States can set up federal fight on health care reform

Remember the Freedom of Choice in Health Care Act that was on the ballot last year and barely failed with 49.8 percent of the vote? The Legislature has already ensured it will be back on the ballot next year, where it's likely to pass. If it does, it could be joined by other states around the country to trigger a much-needed reset of the relationship between the states and federal government.

The 2008 ballot proposition was plain vanilla. It would simply have prohibited laws that restrict a person's choice of private health providers or the right to pay for medical services. The opposition, well-funded by insurance plans and business groups, argued simultaneously that it would do nothing and that it would limit future legislative options. Whipping out the fear-of-the-unknown card, they claimed, falsely, that Medicare and Medicaid patients could lose coverage. It was all typical technique for a "no" campaign, but in the end they confused enough voters to eke out the victory.

Today, Americans are much more focused on health care policy and they have more reason than ever to build firewalls for themselves against an over-reaching federal government. The powers in Washington keep marching forward, determined to eventually bring our health care options under their control.

The history of past federal programs also suggests a strong need for caution. Courts and bureaucrats have a habit of morphing federal programs into forms vastly more comprehensive than originally intended. Social Security was created as a modest supplement for poverty-ridden seniors. Today's retirees receive a fraction of the income they could have received if they could have saved and invested their own payroll contribution dollars. Yet Social Security owes to future beneficiaries trillions of dollars that we don't have, casting a pall over the economic future of the country.

So Arizonans are only being practical to seek protection at the state level from relentless federal intrusions. Yet, even if the Freedom of Choice in Health Care Act passes on the state level, it will be challenged on the grounds that federal legislation pre-empts state law.

The complicated legal arguments about pre-emption will have to be duked out in court. But the threat to freedom-loving people today is the centralization of power in a federal government that ceaselessly expands and intrudes. Surely, our system of federalism doesn't permit the feds to extend more control over the decisions of our daily lives while the states helplessly look on. Let's hope the Freedom of Choice in Health Care Act will be the driver for fundamental change.

Mayor Parker: Governors Need to Lead by Example

Mayor Vernon Parker Says He Would Cut Governor’s Office Budget On Day One; Says Any Serious Gubernatorial Candidates Should Pledge the Same

OCTOBER 5, 2009. With the possibility of an 18 percent state-wide sales tax increase looming, one potential gubernatorial candidate not only thinks that is a bad idea, he is calling for cuts in the budget of the Governor’s Office itself.

“It is only fair to do what you are asking others to do…cut,” Paradise Valley Mayor Vernon Parker said. Parker believes Arizona should instead be talking about phasing out corporate taxes, a remedy for growing the economy. Parker recently formed an exploratory committee to pursue the Governor’s Office in 2010. * (JLBC spending levels for Arizona Governor’s Office referenced below.)

“Many Arizonans are suffering. Many state agencies are cutting. The Governor’s Office should do the same. I will,” Parker said. “Should I be fortunate enough to be elected Governor I would make these necessary cuts on Day One.”

Parker has presided over budget cuts as Mayor of Paradise Valley. Spending has been reduced by 25 percent while the budget for Mayor and Council has been reduced by 54 percent. Parker also fought off a major effort to increase the bed and sales tax in Paradise Valley.

“Republicans willing to raise taxes will not beat a career politician like Terry Goddard. We need a fresh voice, new message and someone who can fight on Terry’s turf rather than he on ours. One career politician will not beat another,” said Parker.

Parker, 49, is the current mayor of Paradise Valley, Arizona. He has previously served as a Special Assistant to the first President Bush in The White House, and has served George W. Bush as an Assistant Secretary for the $90 billion United States Department of Agriculture. He is a lawyer and a small businessman.

Parker has the most compelling life story of any candidate emerging for governor. He has overcome many odds, and has pledged to help Arizona overcome some of its most difficult economic times since the Great Depression. “I truly believe it’s going to take someone who has defied the odds to help Arizona overcome the odds now facing it. And we can start with a Governor’s Office that believes in shared sacrifice,” Parker said.

Goldwater Institute: New study confirms charter schools benefit disadvantaged students

A new random assignment study on charter school achievement found significantly higher academic gains for students attending charter schools.

The study, conducted by Stanford economist Caroline Hoxby, examined test results for students in New York, and compared the academic gains of those students who win a lottery to attend charter schools to those students who lose the lottery and remain in traditional schools.

The Wall Street Journal reports:

Among students who had spent their academic careers in charter schools, the average eighth grader in Ms. Hoxby's study had a state mathematics test score of 680, compared with 650 for those in traditional schools. The tests are generally scored on a roughly 500 to 800 scale, with 650 representing proficiency.

Ms. Hoxby's study found that the charter-school students, who tend to come from poor and disadvantaged families, scored almost as well as students in the affluent Scarsdale school district in the suburbs north of the city. The English test results showed a similar pattern. The study also found students were more likely to earn a state Regents diploma, given to higher-achieving students, the longer they attended charter schools.

In Arizona the rate of new charter school openings has stalled in recent years. Other states have raced ahead by allowing universities and cities to authorize charter schools. Arizona should follow the examples of these states and encourage charter schools that provide access to high-quality education for our most vulnerable students.

Federal and state court rulings conflict on new AZ abortion laws Phoenix, AZ - Oct. 5, 2009--After pro-abortion groups filed lawsuits in both state and federal courts seeking an injuction against recently passed AZ laws protecting women, parents, and the conscience of healthcare workers, the two courts delivered opposite rulings. Federal court Judge David Campbell refused to grant an injunction, citing the 1992 Supreme Court casePlanned Parenthood v. Casey: “In Casey, the Supreme Court held that a 24-hour waiting period substantially identical to the Arizona provision did not impose an undue burden on the right to obtain an abortion,” and in addition, Campbell wrote, “Casey held that States may require that women be fully informed of the nature and consequences of their abortions, and may even advocate for childbirth over abortion.” But at the state level, Maricopa County Judge Donald Daughton, who according to FEC records donated $1250 to known pro-abortion candidates Barack Obama and Congessman Harry Mitchell, was called out of retirement to rule in favor of the nation’s largest abortion provider, Planned Parenthood, who challenged the laws’ constitutionality. The ruling offers no qualitative reasons for granting the injunction (Full text of Daughton ruling). Arizona Right to Life President Jinny Perron questioned the validity of the Daughton ruling. “These laws were thoroughly vetted for constitutionality over several years by attorneys at Alliance Defense Fund, Bioethics Defense Fund, Center for Arizona Policy, and here at Arizona Right to Life,” said Perron, “so why was this high-profile case assigned to a retired judge tasked with interpreting the Arizona Constitution and issuing a ruling the day before the law was supposed to take effect?” ###

CAP: Abortion Lawsuit Update

CAP and our allies are continuing to work to defend the Abortion Consent Act, despite the setback in state court this week when the judge prevented key provisions of the law from taking effect. The judge's decision could be appealed by the Attorney General's office, or the case could proceed to a trial. In federal court, CAP's motion to intervene is still pending. Stunning Revelations

Documents filed by Planned Parenthood and the Center for Reproductive Rights in the two lawsuits against Arizona's new abortion laws reveal some stunning insight into the practices of the abortion industry. Here are a few examples:

* As a standard practice, a woman seeking an abortion never meets with or discusses the procedure with a doctor until the doctor comes in to perform the procedure. Women who have a medication abortion often never see a doctor, as non-doctors such as nurse practitioners or physician assistants dispense the medication.
* There are no doctors on site at nine of Planned Parenthood's 19 "health centers" statewide. One physician works six half-days per month at the Tucson Planned Parenthood clinic - the remainder of the time, a nurse practitioner performs all procedures without supervision by a physician. Planned Parenthood states that they cannot find doctors willing to work for them.
* Abortion is big business. The price for an abortion is between $450 and $2,100, depending on how far along the pregnancy is. Even at the base price of $450, the two private doctors in the federal lawsuit (not affiliated with Planned Parenthood) are bringing in annually $374,000 and $972,000, respectively, from abortions alone. As the Bible reminds us, "Love of money is the root of all kinds of evil." (I Timothy 6:10)

The remarkable lack of care for women's health and wellbeing by these abortion providers is a continual reminder that there are two victims for every abortion - the mother and her preborn child. Please continue to pray that the Abortion Consent Act will be upheld so that women in Arizona are protected.

Homosexual Activist Overseeing Your Kids' Schools
More light is being shed on the radical history of Kevin Jennings, President Obama's leader for "Safe and Drug-Free Schools." Even the mainstream media has realized that this man is supporting pro-homosexual views that are outside the norm and harmful to school children. When he was a leader of a pro-homosexual organization, Jennings stated that his goal was for people to not be concerned if a homosexual agenda was being promoted in schools. Greyhound Park to Close

This past year, as gambling advocates tried to convince the Arizona Legislature to expand gambling to solve the state's budget problems, we heard claims that expanded gambling would bring in revenue, despite the economic downturn. It sounded too good to be true for the state because it is. This week, news came that the Phoenix Greyhound racetrack will be shutting down by year's end. Gambling is not recession proof, and if the demand is not there to support a racetrack, the state government should not be bailing it out with casino-style gambling. CAP is grateful that the Legislature saw through the claims of gambling advocates, and we will continue to oppose any expansion of gambling in our state.

Study: Immigrants Leaving Arizona

A new report by the U.S. Census Bureau said Arizona and other states have fewer illegal immigrants than last year.The study cited the economy as the main reason that states like Arizona have become less attractive to illegal immigrants but Hispanic advocates also said there is no doubt some are afraid of increased efforts to crack down on illegal immigration.....In particular, Jones said undocumented workers are afraid of the Maricopa County Sheriff's Office, which has made fighting illegal immigration a priority in the past few years."I believe this illegal immigration fight is paying off overall by reducing crime," said Sheriff Joe Arpaio.

According to the Arizona Department of Education, the K-12 Student population is down across the state (including the children crossing our Southern borders illegally to attend our schools free of charge). The K-12 budget survive the 2009 budget cuts, received more money from the state via the revived equilization tax (and more) and in addition K-12 received even more money from the Obama Stimulus Package. Our current Governor wants to pass a 18% sales tax hike to provide MORE money to K-12 education and 28 school districts are campaigning for a budget over ride election using the slogan "It won't increase your taxes". Politics on the Rocks wine tasting event to benefit AZ Right to Life

Politics on the Rocks is proud to announce that we will be holding a Wine Tasting Event at The Estate House located at 7134 East Stetson Drive in Scottsdale on Tuesday, October 13th at 6:00 PM.

Politics on the Rocks will be raising money for Arizona Right to Life. Although this is a free event, if you choose to partake in the $15 Wine Tasting Event (includes 3 glasses of the wines listed below), $5 of the proceeds from each wine tasting purchased will be given to Arizona Right to Life. Of course you can choose to pay more than the $15 and donate additional money to both organizations.

Here are the wines being served during the Charity Wine Tasting Event:

2007 Tunnel of Elms Chardonnay

Dry, medium intensity white wine. Highlights of bright citrus and tropical fruit flavors are held together with a rich creamy core.

2003 Truchard Cabernet Franc

Aromas of black pepper, bell peppers and paprika. About 7% of Cabernet Sauvignon delivers an additional component of fruit and cassis. All in all the wine is balanced, succulent and very food-friendly.

2007 Tunnel of Elms Cabernet Sauvignon

Dry, full intensity red wine. Ripe black fruit and sweet plum flavors with a hint of basil and black pepper.

CAP: State Court Stops New Abortion Measures from Taking Effect!

Late Tuesday, Maricopa County Judge Donald Daughton agreed with Planned Parenthood and decided that key provisions of Arizona's new abortion laws should not go into effect as scheduled on September 30. The judge gave no reasons for his decision but simply accepted Planned Parenthood's assertion that portions of the law should not be enforced while the lawsuit continues. Judge Daughton further denied our motion to intervene in the lawsuit.

For now, the judge's ruling has the following result:

1. Non-doctors like nurse practitioners may continue to perform first trimester surgical abortions.
2. Women do not have a right to an in-person consultation with a doctor 24 hours before having an abortion.
3. A parent's consent to their minor daughter's abortion does not have to be notarized.
4. Arizona's law granting rights of conscience protection does not cover abortion medication or pharmacists and pharmacy owners.
   

Judge Daughton's ruling, however, does allow these provisions to go into effect:

1. 24-hour waiting period after the woman is provided information by a "qualified staff member" (although not necessarily in person), including the name of the doctor performing the abortion, the nature of the procedure, its risks and alternatives.
2. Women cannot be coerced into having an abortion.
3. Women cannot be forced to pay for an abortion before the 24-hour waiting period.
4. Women have a right to sue if the information is not provided.
5. Parents have a right to sue if the abortion clinic violates the parental consent statute.
   

In contrast, U.S. District Judge David Campbell in the federal case filed by Center for Reproductive Rights issued a 23-page ruling that abortion advocates had not met the legal standard for him to keep the law from being enforced.

We are very disappointed that Judge Daughton appeared to give little consideration to the needs of women considering an abortion. The blocked provisions are common sense regulations intended to protect the rights of women, parents, and health care professionals. Yesterday's rulings, however, are only "Round 1" in what promises to be a long legal battle.

CAP and our allies will continue to work to defend and protect these laws in their entirety. Now is not the time to grow weary or faint. Rather, it is the time to persevere. We very much appreciate your partnering with us to defend these laws.
