CLE seminar for lawyers, others: Literature & The Law Conference - I will be discussing whether Shakespeare is sexist!

The Maricopa County Bar Association is hosting “Literature and the Law,” an all- day conference event sponsored by MCBA and organized with the assistance of the Law Office of Travis R. Marker.

The conference will address the practical application of the literature to the law and will discuss authors such as Leo Tolstoy, William Shakespeare, CS Lewis, William Faulkner, Beowulf, Franz Kafka, Thomas Hardy, Fyodor Dostoevsky, Chaucer, and other great literary minds who have discussed themes relevant to the law.

This is not a theoretical or academic discussion, the classes and presentations will discuss relevant topics such as advocacy, client interviews, negotiations, problem solving, ethics, and other areas of practical application of the literature to the practice of law.

Editor's note: I will be giving a presentation on whether Shakespeare is sexist. Opponents of classic literature, such as the works of William Shakespeare, are using the legal system to keep timeless classics out of our schools. Feminists claim that Shakespeare is sexist, and successfully got a professor fired from Arizona State University for teaching Shakespeare. Shakespeare has also been accused of being anti-Semitic; “The Merchant of Venice” has been removed from many schools. Others accuse Shakespeare of being too “western,” “English” and “white.” Shakespeare’s “The Tempest” was recently censored from the Tucson Unified School District for being racist. Instead of explaining to youth that these classic works were written in a different era, the books are simply banned, often using the legal system to accomplish this.

Who’s Afraid of an Article V Amendments Convention?



Every so often talk arises about holding an Article V Amendments convention amongst the states to amend the Constitution, since Congress has become increasingly unaccountable. In reaction, dire warnings spring up declaring that a “constitutional convention,” or “con con,” could result in a runaway convention where radical changes are made that fundamentally rewrite our Constitution. Are the doomsday warnings legitimate, or simply scare tactics to block desperately needed reforms?
Legislation is currently being considered in most state legislatures that would begin the process of adopting a National Debt Relief Amendment. Once ratified, it would prohibit Congress from increasing the federal debt unless a simple majority of the states approve. So far, North Dakota and Louisiana have passed the initial legislation with bipartisan support in both chambers of their state legislatures. Ultimately, 38 states will need to ratify the amendment. The language of the proposed amendment is very simple, “An increase in the federal debt requires approval from a majority of the legislatures of the separate states.”

Article V of the U.S. Constitution lays out the process by which amendments are added to the Constitution. Amendments may be proposed by either the states or Congress. Throughout America’s history, amendments have only been proposed by Congress. If proposed by the states, an amendment must then be ratified by three-quarters of the states or by conventions within the states. It is the initial convention called for by the states to propose amendments that naysayers, including some on the right oddly enough, claim may cause dangerous changes to the Constitution, even though it has never happened before.
The Founding Fathers rejected initial drafts of Article V that would have permitted open-ended conventions, and instead adopted very narrow, precise requirements. They rejected language four times that would have provided the mechanism for a full constitutional convention. In Federalist No. 85, Alexander Hamilton explained that states did not need to call for a full constitutional convention since Article V provides full power to amend the Constitution. James Madison specifically supported the use of Article V in Federalist No. 43. Accusations that an Article V Amendments convention will result in a full-blown “constitutional convention” or “con-con” are not correct. There is no such thing as a constitutional convention – it can be found nowhere in the Constitution.

SCR1005 has passed the Senate 16 to 14 and is now in the House. It has been assigned to the Appropriations Committee. We don’t know when there will be a hearing, but please contact the members of the Committee now.

MESSAGE: Vote NO on SCR 1005. Do not put our Constitution at risk by asking Congress to “call a Convention for the purpose of proposing amendments.” Article V of the Constitution does not provide any way to limit an “amendments convention.” We don’t trust the politicians with our Constitution. Barry Goldwater said: "[I am] totally opposed [to a Constitutional Convention]...We may wind up with a Constitution so far different from that we have lived under for two hundred years that the Republic might not be able to continue." 

SCR1005 is a Call for a Constitutional Convention or an “amendments convention” to consider whether an increase in the federal debt should require approval from a majority of the legislatures of the states. Have you witnessed the ferocious battles in Congress over the debt ceiling? Can you imagine what that same battle would entail in a Constitutional Convention which could put our whole Constitution at risk as the “amendments convention” considers multiple versions and multiple amendments?

There is no way provided in Article V of the U.S. Constitution to limit the number of amendments which can be proposed in an “amendments convention,” even if the states, as in SCR1005, try to limit it. Article V states, “Congress…on the application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments…” (that’s amendments in the plural).

The highest authority to ever speak on an amendments convention was Chief Justice Warren Burger. He said, “I have repeatedly given my opinion that there is no effective way to limit or muzzle the actions of a Constitutional Convention. The Convention could make its own rules and set its own agenda. Congress might try to limit the Convention to one amendment or to one issue, but there is no way to assure that the Convention would obey. After a Convention is convened, it will be too late to stop the Convention if we don’t like its agenda…Our 1787 Constitution was referred to by several of its authors as a ‘miracle.’ Whatever gain might be hoped for from a new Constitutional Convention could not be worth the risks involved…” .

 A CONCURRENT RESOLUTION

Applying to the congress of the United States to call a convention for proposing an amendment to the Constitution of the United States to provide that an increase in the federal debt requires approval from a majority of the legislatures of the separate states.

Whereas, Article V of the Constitution of the United States provides authority for a convention to be called by the Congress of the United States for the purpose of proposing amendments to the Constitution on application of two-thirds of the legislatures of the several states ("amendments convention"); and

Whereas, the Legislature of the State of Arizona favors the proposal and ratification of an amendment to the Constitution of the United States that will provide that an increase in the federal debt requires approval from a majority of the legislatures of the separate states.

Therefore

Be it resolved by the Senate of the State of Arizona, the House of Representatives concurring:

  • That, pursuant to Article V of the Constitution of the United States, the Legislature of the State of Arizona formally applies to the Congress of the United States to call a convention for the purpose of proposing an amendment to the Constitution of the United States, to be ratified by the legislatures or by conventions in three-fourths of the several states, that will provide that an increase in the federal debt requires approval from a majority of the legislatures of the separate states.

  • That the amendments convention contemplated by this application be entirely focused on and exclusively limited to the subject matter of proposing for ratification an amendment to the Constitution of the United States providing that an increase in the federal debt requires approval from a majority of the legislatures of the separate states.

  • That this application constitutes a continuing application in accordance with Article V of the Constitution of the United States until at least two-thirds of the legislatures of the several states have made application for an equivalently limited amendments convention.

  • That the Secretary of State of the State of Arizona transmit a copy of this Resolution to the President of the United States Senate, the Speaker of the United States House of Representatives, each Member of Congress from the State of Arizona and the presiding officers of each house of the several state legislatures, requesting their cooperation in applying for the amendments convention limited to the subject matter contemplated by this application.

Apparently Rep. Steve Gallardo went off on a rant on Republicans who had photos of Hispanic children supporting school vouchers on their desks. Come on Gallardo, my boyfriend has four half-Hispanic kids. Does that mean he can't post photos of his own kids on his desk because he's a Republican? Rep. Steve Montenegro's response is below.

STATE CAPITOL, PHOENIX (March 5, 2012) – In a response to the incendiary remarks made to the Arizona Republic by State Senator Steve Gallardo , House Representative Steve Montenegro has released the following statement:

What is appalling and disgusting is that State Senator Gallardo views the Republican led Legislature’s efforts through a twisted and discriminatory prism of a brown vs. white universe. Access to the best education our state can offer should be made available to all children regardless of race or income. Over the objections of grand standing race baiters, Republicans are providing an escape from failing public schools and should be applauded for their efforts. 100% of the scholarships awarded by the organization opposed by Mr. Gallardo (the Arizona School Choice Trust) goes to low income children. The vast majority of students that receive said scholarships are Latinos. The divisive and hateful rhetoric espoused by Mr. Gallardo is a perfect justification for the dissolution of classes that incite racial hatred amongst Latino children. Proponents of those programs seek to create a new generation of radicalized and racially segregated youth. Mr. Gallardo would do well to remember that his oath of office binds him to serve all citizens of Arizona and not just those bearing the skin colors of his choosing.

Matt Salmon: Taking a Stand against Dishonest Campaign Tactics

It has come to our attention that Matt Salmon's opponent for Congress has resorted to dishonest and misleading tactics in an attempt to besmirch Salmon's longstanding conservative credentials.

Former Congressman Matt Salmon has a proven track record of cutting wasteful spending, balancing budgets and demanding fiscal responsibility. He has been honored by the Citizen's Against Government Waste as a "Watchdog of the Treasury" and "Taxpayer Hero" for his performance in fighting to reduce the size and cost of government.

Congressman Salmon's pro-business record also earned him the Spirit of Enterprise Award from the U.S. Chamber of Commerce each of his six years in Congress and six consecutive honors as a "Friend of Small Business" from the National Federation of Independent Business. His record of advocating for pro-business policies and fighting to reduce regulations is why he was hired by COMPTEL Inc., a leading telecommunications trade association.

Former Congressman Salmon was hired by the association in 2008. Yesterday, his opponent made an accusation that was called "blatantly false" by the Arizona Capitol Times that attempted to tie Salmon to a contribution made to Hillary Clinton by COMPTEL PAC and its board of directors in 2007 - before Salmon even worked for the organization! Regardless of the fact that contribution decisions are made by the board of directors, Salmon's opponent has become so desperate to remain relevant that he has chosen to distort the truth to save his failing effort - only backing down when his false accusations are exposed.

This past week the Chairman of the Arizona Republican Party, Tom Morrissey, wrote to Adams and Salmon warning, "misrepresentations of records, and character attacks, which are not supported by the record, do a disservice to our entire party and the integrity of both you fine gentlemen."

Unfortunately, this is not an isolated incident when it comes to Salmon's opponent using dishonest tactics to try to mislead the voters about his conservative record. Last week, Salmon's opponent took to using a "push poll" to spread misinformation and deceitful allegations. This tactic was recently made illegal in the state of New Hampshire and is banned under the code of ethics of the American Association of Political Consultants.

We must speak out against these desperate attempts to deceive voters, and set the record straight. No one should be misled by the desperate attempts of a dishonest and failing campaign.

Salmon's record is beyond reproach:

• As a member of Congress, helped to balance the federal budget for the first time in over a generation

• Rated in the top five among all 535 members of the House and Senate by the Citizen's Against Government Waste - 6 consecutive years

• Earned Watchdog of the Treasury from the Citizen's Against Government Waste - 6 consecutive years

• Received the Taxpayer Hero Award from the Citizen's Against Government Waste

• Spirit of Enterprise Award from the U.S. Chamber of Commerce - 6 consecutive years

From the Yellow Sheet: In January, Adams unveiled a web video in which one of his campaign staffers gets reactions from East
Valley voters when they learn that Salmon, during his time as a congressional lobbyist, made contributions
to Democrats Pastor and Joe Baca (D-­CA) in 2009. The latest Adams campaign video (
CONSORTING WITH THE ENEMY
LINK) alleges that
Salmon, as treasurer of a PAC for communication service providers, gave $2,000 to Hillary Clinton in
September 2007. However, that appears to be blatantly false, as Salmon did not work for Comptel or its
PAC at the time. Salmon critics are also saying Comptel, under Salmon’s leadership, gave heavily to Dems,
though those claims also don’t seem to be supported by the facts. One railbird noted that it was somewhat
odd that Salmon and Schweikert have “teamed up” and endorsed each other, given that a PAC Salmon was
tied to in 2008 gave money to Mitchell, and not Schweikert. Federal contribution records show that the
PAC operated by Comptel gave $49,228 to Dem congressional candidates and only $32,500 to Republican
candidates. Given that Salmon was Comptel’s president at the time and treasurer of the PAC, the railbird
said he was complicit in helping Dems get elected. (Of the 22 Dem candidates that received money from Comptel that year, only 10 had GOP opponents, and most were lopsided victories for the Dems. Mitchell’s
53-­44 victory was the closest contest.) However, FEC records show that Salmon did not become treasurer
of the PAC until July 15, 2008, long after many of the contributions were made. (Salmon was named
president of Comptel in January 2008, but he reported to CEO Jerry James.) After Salmon became the
PAC’s treasurer, the committee actually gave more money to Republicans: In the last half of 2008, the
committee gave $9,000 to GOP candidates and only $4,500 to Dems. Salmon left Comptel in March 2009
to form lobbying firm Policy Impact, which has since been renamed Upstream Consulting. A call to
Salmon was not returned.

Mr. Barton will discuss the United Nations Conference on Environment and Development (UNCED) or Earth Summit, held in Rio de Janeiro in 1992. The Accord was adopted by 178 governments.  Its short title, Agenda 21, is a comprehensive plan of action to be taken globally, nationally, and locally by organizations of the United Nations System, Governments, and Major Non-Governmental Organizations in every area in which humans impact the environment. The Commission on Sustainable Development was set up to monitor and ensure effective implementation of the agreement. They meet every five years to measure progress.

Through International Council for Local Environmental Initiatives, or ICLEI and the President's Council on Sustainable Development, this global program for complete control has been growing and gaining strength for nearly 20 years. Presently the cities of Chandler, Flagstaff, Goodyear, Peoria, Phoenix, Tempe and Tucson are ICLEI members committed to the United Nations program known as Agenda 21.
