Filing Chapter 7 bankruptcy in Arizona? Don't make these mistakes!

I am a bankruptcy attorney in Arizona, and came across an excellent article warning people considering filing for bankruptcy not to make a couple of dangerous mistakes.

1. If I transfer my property to my family and friends, I can get it back when I am done with bankruptcy.

2. I should use my credit card’s entire available balance right before bankruptcy since it will be discharged anyway.

An Open Letter to All LD-18 Voters:
Gentlepeople,
I thought I would let those on my email list and another list that was shared with me, receive my report of what happened at the Republican LD18 Meeting [Oct. 25th] when the only speaker was Jerry Lewis.
I came away from the meeting feeling sorry for Jerry Lewis. He seemed to be a male version of Olivia Cortes, over his head and caught in the middle of a struggle hard core left wingers are waging against a powerful state senator. Someone got Olivia to run. Another someone got Jerry Lewis to run.
Jerry Lewis started out the meeting telling everyone that, yes, he was fired from two jobs since leaving his accounting firm and that he was fired at gunpoint from one of those jobs. He acknowledged that his school was involved in a (nearly two million dollar) fraud lawsuit and that he had been implicated by a disgruntled former employee in giving out items contributed to his school to use in a yard sale. Allegedly one person netted a thousand dollars from those yard sale items. No one asked him about these things, he volunteered the information and you could see that he would rather have that information never brought up in the first place.
He emphasized that he had done nothing wrong and Rae Beth believes him. However, when you have to address things like this, you lose. Rae Beth told me that she bet Jerry Lewis wishes he never would have run because he will not be known for his good works to many people in Mesa. For many, he will be known for just the opposite.
Jerry Lewis did have supporters there but in questions from the floor you could see that many in the audience were seething with rage at his candidacy. Galen Updike, the former President of the Arizona Senate prior to Russell Pearce winning that honor from his Senate colleagues, pointed out in the first question from the floor that Jerry Lewis could never be elected again in LD 18 if he took out Russell.
In that regard, Jerry Lewis was asked if he would run again and he was very uncomfortable with that question saying he would make a decision when it came time to run.
It was clear that whoever signed Jerry Lewis up for this task wasn’t thinking about Jerry Lewis. His good name was being sacrificed and his name will go down in the minds of many who will associate him with nothing but contempt. Jerry Lewis knows that and he wants to be respected. He pointed out that he WAS a good man, having served a mission and learning Chinese. He asked someone for a glass of water and told the audience the water was being delivered by his home teacher. He told us he had served in a “high church calling” and he was Seminary and Institute teacher. He acknowledged he had no teaching credentials but he loved to teach religion more than any thing else. Jerry Lewis said these things to recover his respect.
Everyone wants respect and my heart went out to Jerry Lewis. He could very well get elected one time only, but he will be powerless for the limited time he serves and our district will have little representation. If he wins his good character will NOT be vindicated. Contempt for him will only increase. What a terrible position to be in. Many people may want to help him but if he loses he will be pitied. If he wins he will be despised.
Why did Jerry Lewis get into this situation? He said he entered the race for something like changing the dialog to a “civil tone” and blinked when we received a question noting 30 states had copied laws authored by Russell. A well dressed young man asked why we had to change the dialog when we finally had someone able to address issues of concern important to the vast number of people there. I don’t recall Jerry Lewis’  response.
A former State Senator who was present told me that there would be three caucuses in the Arizona Senate. The Republican Caucus, the Democrat Caucus and the Jerry Lewis Caucus. Jerry Lewis is the chosen candidate of the Democrats and the Occupy Phoenix people and some others who knew him before he agreed to take on Russell Pearce when no one else would do so.
Jerry Lewis claimed he did not know who had prepared the smear publications against Russell and mailed them from a post office box in Tempe. He mentioned that election officials in Arizona had contacted him about this shadowy group and he asked the audience if anyone knew who was behind these smears to tell them that they needed to comply with election laws, which apparently they have not. He said it costs $10,000.00 a mailing so they had spent $ 30,000.00 in support of his candidacy but he did not know where their money came from. Olivia Cortes didn’t know who her supporters were. Neither does Jerry Lewis know who his supporters are.
Henry Haws stood and told Jerry Lewis that Jerry had spoken at Rotary and he (Henry) had asked him a question which Jerry had not answered so he wanted a response at this time, and Henry asked the question again. Jerry Lewis talked for a while but he did not answer the question. The
audience started shouting to him to respond but he said that time was up. He left. A woman jumped up and shouted, “So much for this job interview!”, and it looked like she chased after him.
Members of the audience asked the LD Chairman who decided he would leave at 8:00 when in a previous meeting Russell Pearce answered questions until 8:30 and he said, “The Candidate decided that”.
After the meeting, I voted my absentee ballot. I voted for Russell Pearce.
An interesting fact is that all but four Arizona Republican Senators have assigned on as supporters of Russell. One who did not, is Rich Crandall. It turns out that both Rich and Russell could end up in the same district due to redistricting so a win for Jerry Lewis would take out the biggest challenge to Rich Crandall. According to the Arizona Republic, financial support to Jerry Lewis has come from the Crandall Family.

Special Interest Groups Spend Lavishly to Remove Pearce from Office

Over $200,000 Spent by Multiple Committees
MESA, AZ – Several left-leaning independent expenditure groups have spent $170,000 to unseat Arizona State Senate President Russell Pearce. This figure does not include the activities of the yet-to-be-disclosed “Citizens United for Progress” committee that is under investigation by the Attorney General’s office for illegal campaign activities.
Pearce campaign chairman Chad Willems said, “It’s no surprise. This is what our campaign has been saying all along which is an outside group of liberal special interests want to overthrow the will of the majority in District 18.”
Meanwhile, the Patriots for Pearce campaign reported raising $230,000 from 2,200 donors. Nearly 80% of the donations are from Arizona residents. The committee has just over $70,000 cash on hand – and continues to fundraise at a record pace.
“We have been humbled by the tremendous outpouring of support for Senator Pearce and his agenda for a strong, safe and secure Arizona, creating private sector jobs, balancing our state budget and strengthening education through choice, accountability and performance pay,” Willems added.
In reviewing the independent expenditures in support of Jerry Lewis, the Arizona Capitol Times reported earlier this week that the “Public Campaign Action Fund’s funding largely comes from liberal interests, including Common Cause, MoveOn.org, the National Education Association, the Service Employees International Union and the Tides Voter Action Fund.”
“It’s obvious now more than ever that Jerry Lewis is a puppet of his left-wing supporters. Jerry is simply aiding and abetting these groups’ attempts to remove Senator Pearce from office. If this was a bank robbery, Jerry may not be holding the shotgun, but he would definitely be driving the getaway car,” Willems concluded.

2.  Phone Calls!  We have had many volunteers make phone calls on the campaign and the feedback we get is always the same:  people are very receptive to hearing about a candidate!  You can join us in these efforts in two different ways.  The first way is the Phone Bank we're doing Monday-Thursday from 5:30-8:00 pm at 3501 N 24th St. here in Phoenix.  The second way is to make calls from home!  Simply email us and we will send you a list and a script.  These calls can be made from anywhere and will only take about 2 hours.

Why are Suicides so High in the Wealthiest Country in the World?


Although the U.S. is the wealthiest country in the world, our suicide rate is the 39th highest in the world. Last year, 35,000 adults in the U.S. committed suicide. A new report by the Centers for Disease Control and Prevention found that 1 in 100 adults planned to commit suicide in the past year, a total of 2.2 million adults. Of those, young adults ages 18-29 and women were more prone to suicidal thoughts and behavior. The number of Americans contemplating suicide is alarming; for every suicide there are estimates of anywhere from 11 to 25 attempted suicides.
Suicide rates traditionally increase during recessions and decrease during economic booms. Yet even during economic downturns, Americans are better off than most people in third world countries. There is an extensive “safety net” of government programs that provides monetary assistance and food for families that encounter hard times. More than 10 percent of Americans receive food stamps. More than 50% of all babies receive some kind of government assistance. Americans may not be wealthy, but they have enough to get by comfortably.
What explains the high rate of suicides? Materialism. American culture places an increasingly high value on status and acquiring things. However, at the same time there has been a decline in teaching our children the value of hard work. Children are being taught ethnic studies in place of social studies, they are being taught revisionist history, and are generally being dumbed down and taught victimhood. They are coming out of school less prepared for the rigors of life and lack a strong work ethic.
At the same time, our youth have been led to believe they can have it all; dining out frequently, fancy cars, a big house, designer clothes, big-screen televisions, the latest expensive electronic gadgets, and multiple wireless phones. They are spoon-fed television shows of the rich and famous living well beyond the means of most Americans, but the shows portray these stars as if they are regular folks just like you and me. The Kardashians is but one of many reality TV shows featuring exorbitantly wealthy glamorous stars who young girls look up to and emulate. This sets young people up for unreasonably high expectations. When they inevitably run into financial difficulties, often brought on by illness, loss of a job, divorce or child custody legal battle, they are maxed out financially and have no money left to spare. Obligated to hefty mortgages, long- term wireless phone contracts, and other binding contracts, their dismal financial situation is compounded.

Kirk Adams Launches "Push" Poll

Yesterday, we mentioned that we heard from someone that there was a poll going around promoting Kirk Adams.  We asked about it yesterday on twitter and have since received confirmation from two other sources who were also called with the pre-recorded survey.

All three reports are virtually the same.   They reported receiving an auto-poll paid for by the Kirk Adams campaign asking a series of questions. Here is the general order:

 - Are you likely to vote in the race for Congress?
 - Who are you going to vote for:  Kirk Adams or Matt Salmon?
 - Knowing that Matt Salmon has not lived in AZ the past several years but in
 - DC as a lobbyist, does this change your opinion of him?
 - Now, knowing this information, who are you going to vote for:  Kirk Adams or Matt Salmon?
 - What is your age?
 - What is your gender?
 - What is your religious affiliation?

A "push poll" is described as "a form of telemarketing-based propaganda and rumor mongering, masquerading as a poll."  Do you see the push poll question tucked right there in the middle?  The Adams campaign has been trying to promote the lobbyist issue for awhile, but now they are taking it to a new level by broadcasting it in the form of a "poll."  Are they seriously trying to label Matt Salmon as some sort of carpet-bagger?  Didn't he grow up in Mesa?

So the question is: why are they doing this?  Is it because fundraising isn't as going as well as they had hoped?  Are they trying to put out survey "results" that show the race is closer than the 30 point lead that Salmon announced?  Do they think something like this would actually work?

Another question: what value will they find in the religious affiliation question.  How is that going to impact this race?

We are still 10 months from this election, if Adams is already doing this, where does he go next?

Filing Chapter 7 bankruptcy in Arizona? What happens to your jewelry?

More Proof Leftists Conspiring to Elect Jerry “The Judas Goat” Lewis

This following image is of a post card that was recently sent to voters in Legislative District 18 that falsely pretends to be from Helen Purcell as an official communication from the Maricopa County Recorder’s Office.
Presently, the Secretary of State, Ken Bennett,  is investigating it as an illegal mailer. Even though it was sent by Citizens United for Progress (a leftist organization) and they are NOT directly connected with the Lewis campaign, it will probably be found illegal resulting in the group being fined. But it reinforces the claim that the left is backing Lewis at any cost including violating campaign finance laws as Lewis turns a blind eye and refuses to condemn illegal behavior.

Incidentally, Stephen Lemons with the Phoenix New Times still refuses to show the front side of the postcard. Ah, the sin of omission.

Mesa’s District 18 has one of the most effective legislative leaders in recent history, but a group of outsiders has hijacked the will of Mesa voters, forcing a new election and raising the real possibility that Senate President Russell Pearce could be forced out of office.
With early voting beginning in the district, it is time for voters to look at the two men running in this race and decide which one of them best represents them at the state Capitol.
The residents of District 18 don’t just have an effective senator who understands their needs and works to make the East Valley and the state of Arizona better places. They have a Senate president who successfully engineered one of the most effective sessions in memory.
President Pearce promised voters a truly balanced budget, and he delivered with a package that balanced the books without crippling state agencies. I know how hard he worked to make it happen, because I was right there alongside him at many of the discussions leading up to the budget plan.
President Pearce is a former appropriations chair who knows the state budget back and forth, up and down. His experience is invaluable, and all Arizonans are benefitting from it.
When our caucus voted for Russell to become Senate president, detractors questioned whether he would be able to lead a group with such different opinions on the issues. As the session progressed, the answer became a clear yes. Even when he personally strongly opposed a bill, the president made sure the sponsor got a fair shake. I probably don’t need to tell you that has not always been the case at the Legislature.
After watching the recent hour-and-a-half candidate debate, I still have no idea where his recall opponent Jerry Lewis stands on the issues important to Mesa voters. He speaks in vague platitudes and sound bites. It’s pretty clear why he does this. On the issues, the voters stand with Russell Pearce, and to come out publicly against those issues would be deadly to Lewis’ candidacy.
One thing I did pick up is that he is embarrassed by Mesa and Arizona, and in his warped world, Arizona is like 1964 Alabama. Not quite. Alabama is actually trying to become 2011 Arizona, joining 34 states in adopting tough legislation on illegal immigration. Alabama would also like to have the job-creation numbers we have in Arizona. President Pearce’s focus on the economy and jobs is making a difference in this state, and better days are ahead. Arizona can’t afford Jerry Lewis.
Since Mr. Lewis won’t let us know where he stands, we are left to try to learn more about his comrades behind the recall. Randy Parraz is a failed Democratic candidate for U.S. Senate and an open-borders advocate. Chad Snow is a lawyer who represents illegal aliens suing their employers. With supporters from the loony left, are voters sure they want to put an unknown, inexperienced and unproven candidate in office?

Goldwater Institute: Imagine a world without secret voting


Imagine you live in a world where all your votes are public knowledge – no voter privacy, no voting booths, and no mail-in ballots. What if you could be approached in public and asked to cast your vote on the spot?
As an illustration, imagine visiting a hospital to check on a friend. Outside, you see two large groups protesting – pro life and pro choice. With no other way in, you put your head down, and walk discretely toward the main entrance.
You let out a sigh as two shoes start moving your way. A booming voice rings out, “Do you know how you’re going to vote on ballot initiative 99?” You look up and see an intense face, a pin advocating the position you disagree with, and reinforcements closing in: “This initiative will have huge impacts on abortion rights, you know.”
You shift uncomfortably but try to stand up straight and respond. “Yes, I do know how I will vote.” Another volunteer hands you a card. “No time like the present. Go ahead, vote right now. We’ll watch.” Your gulp is audible.
Clearly this is uncomfortable and not what many of us would want – the potential for intimidation is obvious. But if the National Labor Relations Board (NLRB) under President Obama gets its way, this is exactly what the workplace could look like for millions of workers.
Last year, Arizonans overwhelmingly passed a constitutional amendment that told workers “if your company is deciding whether or not to unionize, you have a constitutional right to cast your vote in secret.” But now, the NLRB is trying to strike down the amendment through a federal lawsuit. If they succeed, a union sympathizer would be permitted to accost a fellow employee and watch as the employee votes on whether or not to unionize.
But the Goldwater Institute is fighting back, defending the amendment in court. We’re hopeful that this effort to protect workers’ right to a secret ballot – already duplicated in five states, with more to follow this year – will prevail.

REP. SCHWEIKERT TO HOST JOB FAIR IN SCOTTSDALE ON FRIDAY

Stanton dodges police chief hire


Wes Gullett says it’s the top job of the next Mayor
PHOENIX – Phoenix needs a Police chief. Wes Gullett wants to hire one. Career-politician Greg Stanton, as is typical, won’t commit.
At a debate last Friday at Phoenix Country Club, Stanton refused to commit, if elected, to the city hiring a police chief in the first three months of taking office, as Gullett has done.
The former police chief of Phoenix resigned months ago, yet the search for a replacement has barely begun. Phoenix has had an “acting police chief” since early March. Gullett called for a national search to begin at that time.
While Stanton won’t commit on this issue, he has outlined more than 40 ways to grow government on his own Web site.
“The most sacred responsibility of government is public safety,” Gullett said. “If we do not feel safe in our homes, our places of work, schools and public venues we cannot succeed as a city in the long-term.”
Gullett says the city has waited too long, and the process needs to start immediately.
Stanton’s refusal to answer the question follows a troubling pattern of indecisiveness and evasiveness, reported last week by the Arizona Republic.
“Phoenix needs leadership,” Gullett said. “We need a Mayor who will have the courage to make the tough decisions and get Phoenix working again – not someone who is unwilling to even tell voters what he thinks.”

My other very exciting news for this week includes the Athena Awards Luncheon put on the by the Greater Phoenix Chamber. I'm extremely honored to have been selected as a finalist for the Young Professional Athena category, and this Tuesday, is the day when 2011 recipients of the prestigious award are announced. Many of the Valley's top-notch organizations and companies participate - so it's great networking and overall just a great event! Good luck to all the finalists!

This is a 'don't-miss' workshop!  Learn how you can be liberated from the lies of "separation of church and state" that have kept you from freely and confidently living out your faith at work.    

Eric Buehrer, with Gateways to Better Education, and Jeremy Tedesco, an attorney with Alliance Defense Fund, will be the instructors.  Attendees will receive certificate of completion for 3 hours of professional development training that can be used toward continuing education requirements.
