Goldwater Institute asks U.S. Supreme Court to Apply 14th Amendment to Property Seizures

Institute files amicus brief in Alvarez v. Smith to protect private property
Phoenix--In 2002, a New Jersey woman named Carol Thomas made headlines after her teenage son used her 1990 Ford Thunderbird to sell marijuana to an undercover police officer. He was arrested, pled guilty and faced his punishment. But that did not end the case. The government also seized Thomas' car, despite the fact that no drugs were found in the car, she was the sole owner, and she had no knowledge of her son's use of the car to sell illegal drugs.

The government's action was based on a legal doctrine called civil asset forfeiture that allows police and prosecutors to seize and forfeit property without ever filing criminal charges against the property owner. A class action lawsuit challenging these types of laws has made its way to the U.S. Supreme Court and the Goldwater Institute filed an amicus brief in the case asking the Court to protect innocent property owners from abusive asset forfeiture laws. These laws often authorize the government to seize private property suspected of being used in a crime without allowing property owners a timely opportunity to challenge the seizure as wrongful.

Alvarez v. Smith challenges the civil asset forfeiture law in Illinois. Since 1994, Chicago police officers have seized automobiles and cash from numerous property owners, including some who have not been charged with any crime, based on the suspicion that the property had been used in a crime or were the proceeds of a crime. This was done under the authority of an Illinois civil forfeiture law but without any judicial warrant.

This year, these property owners won a decision from the U.S. Court of Appeals for the Seventh Circuit that they were entitled to a timely judicial hearing to prove that their property had been wrongfully seized. The Court of Appeals ruled that the U.S. Constitution's 14th Amendment guarantee of due process of law required the hearing to take place as soon as reasonably possible. The decision was appealed to the U.S. Supreme Court by the Cook County Attorney's office in an effort to maintain the power of the State to delay hearings on civilly seized properties for as long as 187 days after seizure, which is permitted under Illinois law.

"The Supreme Court's ruling in this case could dramatically strengthen, or weaken, the protection given to property owners from wrongful government seizure," said Nick Dranias, an attorney and director of constitutional studies at the Goldwater Institute.

Civil forfeiture laws in Arizona and elsewhere typically allow the government to seize real and personal property that is merely suspected of being used in a crime. As a result, property is routinely seized even if the owners are innocent of any crime, before anyone has been convicted, and if the person who is charged and prosecuted is ultimately found not guilty. The Goldwater Institute examined Arizona's civil asset forfeiture laws in a 2004 report, "Policing and Prosecuting for Profit: Arizona's Civil Asset Forfeiture Laws Violate Basic Due Process Protections." The Institute recommended that Arizona's forfeiture law be repealed in order to protect innocent property owners.

"There is tremendous potential for wrongful property seizure by the government under these circumstances, and the potential for abuse is heightened by the conflict of interest created by laws that allow police agencies to keep the proceeds of property seizures to fund their operations," said Mr. Dranias.

The amicus brief argues that the threat of such abuse means the guarantee of due process of law must ensure that property owners have the opportunity to a judicial hearing to challenge civil property forfeiture as soon as practical. The brief further argues that the guarantee of due process clashes with any civil forfeiture statute, such as Illinois', that allows the government to wait six months before giving property owners the opportunity to prove their property was wrongfully seized.

The amicus brief in Alvarez v. Smith was filed by the Goldwater Institute Scharf-Norton Center for Constitutional Litigation, the Cato Institute, and the Reason Foundation. County supervisors face federal DOJ civil-rights investigation

The Maricopa County Board of Supervisors has been under federal investigation since March for possible civil-rights violations that involve failing to provide interpreters at public meetings for persons of limited English proficiency.

The investigation came to light Tuesday when County Attorney Andrew Thomas published a letter to the U.S. Department of Justice offering cooperation and claiming that his office was only informed of the investigation last week, when county officials approached it for legal help.

County officials deny any sort of investigation cover-up and said they've been working with his office for some time.

Dear Mr. Spencer:
Thank you for contacting me regarding health care reform. I appreciate the opportunity to respond.
The U.S. health care system is the best in the world, spurring advancements in new medical treatments and technologies. Such innovation helps physicians treat and prevent diseases better than ever before, eradicates once fatal epidemics, and helps Americans lead longer, healthier lives.
Despite these advances, millions of Americans struggle to find affordable health insurance options. From 1999 to 2008, the average cost of a family health plan increased by 119 percent from $5,791 to $12,680. Meanwhile, workers' wages increased 34 percent during the same nine-year period. Ensuring access to quality, affordable health care is a laudable goal. I
support targeted solutions that lower health care costs and improve health care by building upon, not completely dismantling, our health care system.
Unfortunately, many of the proposals being considered in the U.S. Senate will make health insurance more expensive, jeopardize Arizonans' current coverage, and expand the government's control over health care. While you will not find the words "ration," "withhold coverage," or "delay access to care" in the pending plans, that is what will result from the web of
federally-dictated insurance reforms, new legal obligations, and provider reimbursement schemes that are part of them. Such policies centralize the power of medical decisions with politicians and bureaucrats, not patients and doctors, and they will result in the delay or denial of care.
There are three main problems with the Majority party's proposals: the implementation of a government-run insurance plan, the use of comparative effectiveness research, and spending.

Government-Run Insurance Plan :
First, the Majority's proposals would create a new, government-run health insurance plan to compete against private insurance plans. The argument is that a government-run plan would give consumers a better range of choices and make the health care market more competitive -- "keep the insurance companies honest," as the President put it. However, well-respected,
independent analysis provides evidence to the contrary. For one thing, a government-run plan would be subsidized by the taxpayers, giving the government plan a huge advantage over competitors. Yet, even government resources are not unlimited. To save money after tens of millions of people are added to the public plan, the government would cut reimbursement to
doctors and hospitals, exacerbating the difficulty Arizonans' already encounter in trying to schedule doctor appointments. To make up for low government reimbursements to providers, insurance companies would have to charge more for private insurance, making it less attractive than the government plan.
Over time, there will only be room for the government plan according to the respected Lewin Group, as 119 million Americans would lose their current coverage. Remember, Fannie Mae and Freddie Mac were designed as independent "government-sponsored enterprises" to complement the private mortgage market. Now, Fannie and Freddie account for a combined share of 73 percent of mortgage originations in the second half of 2008. The two "government-sponsored enterprises" are now effectively owned and run by the federal government, after having sustained losses of over $100 billion last year alone. A Washington-run health care plan will do to the health care market what Fannie and Freddie did to the housing market.


Comparative Effectiveness Research
Second, the Majority's plan would create a new research entity to conduct so-called comparative effectiveness research (CER). CER is a mechanism used by medical professionals to provide information on the relative strengths and weaknesses of various procedures and treatments. In the hands of doctors, medical researchers, and other health professionals, CER can help patients and their own doctors make informed health care decisions. However, in the hands of government, CER can become a tool to delay or deny care. For example, the National Institute for Health and Clinical Effectiveness in Britain uses "cost-effectiveness research" to make health care decisions. By basing treatment decisions on cost rather than need, Britain prescribes fewer cancer drugs than any of the other big five European nations; its patients therefore have the lowest survival rate according to a May edition of National Review. The UK 's system provides only half of the care for end-stage renal disease patients that we do in the United States . Obviously, such rationing of care is not something we should replicate in the United States .
It is telling that none of the Majority's proposals in Congress would bar the federal government from using CER to deny access to care. In fact, when I offered an amendment in April to explicitly bar the use of CER to ration care, it was defeated on a near party-line vote. I have now introduced a free standing bill to ensure that any information obtained through CER cannot be used to deny access to care. The Preserving Access to Targeted, Individualized, and Effective New Treatments and Service (PATIENTS) Act of 2009 (S. 1259) will protect the doctor-patient relationship and ensure access to the highest quality medical care. I will fight at every opportunity to ensure that any health care reform plan the Senate considers later this year protects patients' access to care.

Cost
Finally, the Majority's plans would cost between $1 trillion and $2 trillion, according to the nonpartisan Congressional Budget Office. But even that may understate the true cost. Consider that Massachusetts enacted near universal health insurance in 2006, and costs have exploded, doubling
from $630 million in 2007 to an estimated $1.3 billion just two years later. To deal with those costs, the state has decided to slow enrollment of beneficiaries and eliminate dental coverage for its poorest residents. A special commission, which was established by the state legislature, has now recommended limiting coverage to those health care services that government deems to be cost-effective -- just like government-run health systems in other nations such as Canada and Great Britain do.
Furthermore, the plans would be financed by a combination of new taxes and cuts in Medicare spending, hurting seniors' access to care. The Medicare Trust Fund is expected to reach bankruptcy by 2017. Taking money from one program with urgent solvency problems, such as Medicare, to fund a huge
expansion of health care benefits for others is not sensible.
I believe in the right of every American to choose the doctor, hospital, and insurance plan of his or her choice. No Washington bureaucrat should interfere with that right or substitute the government's judgment for that of a physician. Any health reform proposal should adhere to these principles.

Broken promises, rampant government spending, and Chicago-style politics have marred the first 200 days of the Obama Presidency according to Arizona Republican Party Chairman Randy Pullen. After examining the achievements of President Obama’s first six months in office, Chairman Pullen has concluded that the soaring rhetoric didn’t produce the results Americans so sorely need during this time of economic turmoil.

As unemployment continues to rise and the President’s approval ratings decline, many are taking inventory of the progress made by the Obama Administration and have been disappointed with results. Nationwide polling from respected organizations like the Wall Street Journal, Gallup and CNN have shown President Obama’s polling numbers deteriorate the more Americans learn about him and his political agenda.

“President Obama campaigned on a platform of hope for a better tomorrow,” said Chairman Pullen. “If government spending was the answer to the problems Americans are experiencing right now he certainly has made his best effort to solve the crisis. But we know that burdening future generations with debt is as wrong as it is ineffective in dealing with the today’s economy. But the President seems to think otherwise.”

“During the Democrat President’s first 200 days, he has seemingly made it his mission to spend us into oblivion and Americans are beginning to see the President for what he is. Another big-government, big-spending liberal who thinks that all of our problems can be solved with government intervention,” the Chairman said.

“The President and his administration even found time to bully the state of Arizona and try to intimidate our Senators Kyl and McCain by threatening to withhold stimulus dollars,” the Chairman continued. “That type politics may work for Chicago community organizers, but it is offensive from the President of the United States .”

“I do have to say that President Obama was successful in one thing, motivating our grassroots and improving Republican fundraising,” said Pullen. “People are rightfully concerned with the spending spree that our Democrat President is leading us on. Many feel that under the President’s leadership our country is gotten seriously off track and they need to do something about it. Whether that be taking part in grassroots activism or contributing to our efforts to fight against a plan to institute a government-run healthcare system.”

“So far Democrats have shown that they are part of the problem not the solution. The Republican Party will capitalize on that reality and show that the Party of ideas is alive and well in Arizona , and around the country,” the Chairman concluded.

First official ALA meeting in Illinois a big success!


Fellow Illinoisans,

On Saturday, August the 8th, about 60 Patriots gathered for a three hour lunch meeting in north Chicago. The meeting provided a great opportunity for us to network, get to know one another, understand the background of the American Liberty Alliance, and get a feel for our plans moving forward.

It was encouraging to see so many fellow free-market minded folks ready to unify in a way that hasn’t yet happened here in Illinois. And even more encouraging to see the entire group fully ready for action.

And action is exactly what our next step will be… but first, we must organize.

Our primary goal here in Illinois for the next two months is to organize across the entire state and develop the statewide network into something much more coordinated. The state based Leadership Development Committee will be officially formed this coming week, followed by the launch of a state wide campaign to identify leadership for every community in Illinois.

These community caucuses will begin self-organizing and meeting on a regular basis, with the purpose of becoming locally powered for the free-market movement.

The short term actions are as follows:
1) Begin planning to attend an August 22nd, Recess Rally. (See RecessRally.com for details)
2) Invite everyone you know to become a registered member of the American Liberty Alliance
3) Begin organizing a local “community caucus” in your area (information on this will be provided by the Illinois Leadership Development Committee later this coming week)
4) Plan to attend the state wide American Liberty Alliance Convention in late October (details coming soon)
5) Attend a townhall on healthcare in your area and make your voice heard
6) Begin writing letters to the editors of all media across the state regarding your opinion of current anti-American legislation being proposed
7) Stay active and watch for our emails

More action items will follow, but these are the steps you need to take to help us get off to a great start here in Illinois.

I am not "Cincinnatus" on Sonoran Alliance

Thanks to my friend Politico Mafioso for writing about the libelous accusations against me accusing me of being an anonymous blogger named "Cincinnatus" on Sonoran Alliance. I am an attorney and will not hesitate to sue the anonymous commenter "DGN" who also goes by "Jaime" for libel if he/she continues to make false accusations against me publicly of being Cincinnatus and I find out who he/she is. Aug. 22 Recess Rally healthcare protest

Not only are there massive healthcare protests taking place across the country tomorrow at your local Representative's office, but there will be another one on August 22 spearheaded by the American Liberty Alliance (formerly #dontgo).

For several weeks now, we've been force fed false statements and downright lies about the healthcare legislation Congress is attempting to put in to law. We've all read the headlines, digested the stories and seen the mainstream media sanctioned infomercials. We know exactly what they're trying to do, but liberal Democrats and their followers continue to push the legislation through.

When we combined efforts for the April 15th Tax Day Tea Party, we had more than 20 free-market minded organizations, over 850 organizers, and tens of thousands of American patriots working together to make a unified statement.

Last week, Erick Erickson at RedState.com and I discussed the need for another large scale, widely promoted and unified stance against this dangerous healthcare legislation. After talking with Erickson, the folks at Smart Girl Politics and several other free-market groups, we decided that Saturday, August 22nd (during the Congressional August Recess) would be the perfect day for this nationwide event.

Michelle Malkin, one of our biggest allies for the April 15th, Tax Day Tea Party effort, has joined the coalition along with Smart Girl Politics, American Liberty Alliance, American Majority, the Sam Adams Alliance, Americans for Limited Government, Freedom Works, and RedState.com. The coalition is expected to grow in the coming weeks.

Michelle Malkin said “Now is the time for all good tea party activists to get out on the streets and tell Washington to keep its grubby hands off health care. The socialized medicine brigade is on the run. They're hoping that the August recess will take the steam out of the counterinsurgency, but they are wrong. We will not let up. We are going to get out to a Recess Rally near us on August 22nd. It's crunch time.”

It's crunch time indeed.

On August 22nd, at noon local time, every freedom loving American in this great country needs to be at the office of their elected Representative. We'll be hand delivering a petition and coalition letter, along with a strong and unified message carried by hundreds of thousands of Americans.

The Recess Rally is planned for each and every House of Representative's district office in the country. These Government thugs think they can slip socialism into America without is knowing about it. We think it's time to prove them wrong.

Kill the Evil Insurance Companies

But Then How Do You “Keep Your Plan?”

Washington, DC – While the Democrats continue their infighting on health care reform, they’ve been fumbling around for someone to blame for their troubles . At last, it seems, they’ve settled on a target .

On Thursday, reporters pelted Pelosi with questions about an insurrection by liberal Democrats against a deal cut with Blue Dog Democrats that would significantly weaken the health care public option — and she responded with a withering attack on the insurance industry.

“They are the villains in this. They have been part of the problem in a major way.” (Politico, 7/31/09)

Uh oh. Hide your health insurance card. The Speaker’s on a rampage.

“It’s almost immoral what they are doing,” she said. “Of course, they’ve been immoral all along,”

Hmm, does this sound like a person who wants to make sure you can keep your personal, private health insurance? Of course not. Because, as Rep. Barney Frank (D-MA) made abundantly clear recently, the Democrat health care plan is designed to destroy personal coverage, and create a government-run or single-payer system, in which your only option for health care is Washington.

“I think if we get a good public option, it could lead to single payer. And that’s the best way to get to single payer.”

Americans rightly seek changes to the current structure that will make insurance providers responsive to patients, but the Democrats’ plan won’t empower individuals to make their own medical decisions. It will merely insert the government as the permanent arbiter of health care decisions. As Democrats spread out across the country to demonize personal coverage, patients are left to ask, “Who then will provide my coverage under the Democrat vision of reform?” We’ll give you one guess.
